Accident risks
Common Accident Risks in Oklahoma
Oklahoma's interstates, including I-35, I-40, and I-44, are major cross-country trucking routes, and the Turner and Will Rogers Turnpikes carry high-speed traffic between Oklahoma City and Tulsa. Oil field traffic, rural two-lane highways, sudden severe storms, and a high number of uninsured drivers add to the risk of serious crashes.

Know your rights
Oklahoma Personal Injury Laws You Should Know
Every state sets its own rules for injury claims. These are the Oklahoma rules that most often affect what you can recover and when you must act.
Statute of limitations
Oklahoma generally allows two years for personal injury claims (12 O.S. § 95) and two years for wrongful death claims (12 O.S. § 1053).
Modified comparative negligence
You can recover only if your fault is not greater than the fault of the defendants. Your damages are reduced by your share of fault (23 O.S. § 13).
At-fault insurance system
Oklahoma requires minimum liability coverage of $25,000 per person, $50,000 per accident, and $25,000 for property damage.
Government claims
Claims against the State or a political subdivision require written notice within one year under the Governmental Tort Claims Act (51 O.S. § 156).
Recent Changes to Oklahoma Injury Law
Oklahoma's 2025 tort reform (SB 453): Effective September 1, 2025, Oklahoma reinstated a cap on noneconomic damages in most injury cases, with exceptions for certain permanent and severe injuries. The law also created an optional expedited lawsuit process with a lower damages limit and adopted the federal standard for expert testimony. A separate 2025 law makes litigation funding agreements subject to discovery.
