Accident risks
Common Accident Risks in Massachusetts
Boston-area traffic on I-93, I-90 (the Mass Pike), Route 128 (I-95), and I-495 is among the heaviest in the country, and narrow historic streets mix cars, cyclists, pedestrians, and delivery trucks in tight spaces. Winter storms bring icy roads and sidewalks, and the MBTA, ride-share vehicles, and buses add more ways for people to be hurt. Outside Boston, Worcester, Springfield, and Cape routes see their own seasonal and commuter crash patterns.
How we can help
Massachusetts Personal Injury Cases We Handle
If someone else's negligence caused your injury in Massachusetts, we can help you pursue compensation for medical bills, lost wages, pain and suffering, and other losses. Our Massachusetts practice includes:
-
Uninsured and underinsured motorist claims
Know your rights
Massachusetts Personal Injury Laws You Should Know
Every state sets its own rules for injury claims. These are the Massachusetts rules that most often affect what you can recover and when you must act.
Statute of limitations
Massachusetts generally allows three years to file personal injury and wrongful death claims (M.G.L. c. 260, § 2A; c. 229, § 2).
Modified comparative negligence
Under M.G.L. c. 231, § 85, you can recover as long as your fault is not greater than the combined fault of the defendants. Your damages are reduced by your share of fault.
No-fault PIP
Massachusetts requires $8,000 in Personal Injury Protection, which pays medical bills and lost wages regardless of who caused the crash.
Tort threshold
To sue an at-fault driver for pain and suffering, you generally need more than $2,000 in reasonable medical expenses or a serious injury such as a fracture, permanent disfigurement, or loss of sight or hearing (M.G.L. c. 231, § 6D).
Higher minimum limits since July 1, 2025
Minimum bodily injury coverage is now $25,000 per person and $50,000 per accident, with $30,000 in property damage coverage and $25,000/$50,000 in uninsured motorist coverage.
Claims against public employers
You must present a written claim within two years (M.G.L. c. 258, § 4). Road defect claims can require notice within 30 days.
Recent Changes to Massachusetts Injury Law
Massachusetts raised its insurance minimums in 2025. For policies issued or renewed on or after July 1, 2025, the minimum bodily injury and uninsured motorist limits rose for the first time in decades. That can mean more available coverage for injured people, but many claims still require looking at every available policy.
After an accident

-
See a doctor right away.
Some injuries, including concussions and internal injuries, do not show symptoms for hours or days.
-
Submit your PIP application promptly.
Your own insurer pays the first $8,000 of medical bills and lost wages, and delays can complicate payment.
-
Document everything.
Take photos of the scene, vehicles, and injuries, and collect names and contact information for witnesses.
-
Avoid recorded statements to the other insurer.
Insurance adjusters may use your words to reduce or deny your claim.
